Terms of Use ResidencyAI

These Terms of Use (hereinafter the Terms or the Agreement, as amended from time to time) exclusively govern the use of ResidencyAI (hereinafter also the Services). The Terms are concluded between Stefanos Charalambous as provider of the Services (we/us) and entitled users (You). You are only entitled to use the Services if you are at least 18 years of age. Using the Services implies your full and unconditional acceptance of these Terms.

1. Nature and scope of the Services

The Services consist in a training platform for certain interviews such as medical residencies and similar programs. ResidencyAI will imitate a human interview partner and lead the interview in the form of audio questions and reactions, and provide feedback on your performance and responses (Output). You may answer the questions verbally (Input). The Services are available at https://medinterviews.ai (the Website).

1.1 Provision of the Services based on artificial intelligence

ResidencyAI relies on artificial intelligence (AI) models by third party providers, in particular OpenAI and LiveKit. Any Output is generated automatically by these AI models and may be incorrect, inaccurate, and/or not suitable for the purpose of interview preparation.

1.2 Purpose of the Services, no success guarantee

The purpose of the Services is to assist in the preparation for certain professional interviews, but the Services are not intended as sole preparation tool. There is no guarantee that the content, form or duration of the training sessions interview will match any actual interview content. There is no guarantee that completing a training session and/or achieving a certain result, insofar as the Services comprise feedback on your performance, leads to success in an actual interview.
For clarification, ResidencyAI is not affiliated with any institutes, programs, examination boards or other entity relating to medical education or professional programs, such as the NRMP (or similar programs and institutions).

1.3 Features and availability of the Services

The Services are constantly being developed, improved and adapted, and certain features or aspects of the Services may be added or removed in the future. The exact content and scope of the Services is determined by the information on the Website at the time the training session begins.
The Services are provided on a best effort basis, but it is not guaranteed that the Services will always be available or that they will be available for any particular period of time.

2. User obligations

2.1 Registration, data accuracy

In order to use the Services, you must create an account on the Website (Account). Please make sure that your data are accurate and up to date. You are not authorized to transfer your Account to another person.

2.2 Safety and notification obligations

You must choose a safe password, change the password regularly, and you are obliged to keep the password secret from any other person. You must notify us of any unauthorized access to your password or to your Account.

2.3 Technical requirements, correct use

You are responsible for the required technical setup and hardware on your end to make use of the Services. This includes in particular a stable internet connection, a computing device, a working microphone and a speaker, as well as a quiet environment. Please make also sure to raise your voice and pronounce the words clearly.

2.4 Responsibility for the use of any Output

Because the Services are based on AI models, you must evaluate any output for accuracy and appropriateness before relying on it, answering or otherwise using it.

2.5 Permitted and unauthorized use of the Services

You must only use the Services as they are intended, i.e., as an automated sparring partner for certain interviews. Providing any Input and making any use of the Services which is not in line with this purpose is not allowed.
In particular, you are not allowed to:
  • - provide illegal or inappropriate Input;
  • - use the Service or any Output for illegal or unauthorized purposes;
  • - misuse the Service in any way that could interfere with its functionality, e.g.: overload or disrupt the Services, or use automated tools to access or interact with the Services;
  • - attempt to decompile, reverse-engineer, or tamper with the Service's code or data;
  • - publish any Output (e.g. audio recordings or transcripts).

3. Service credits, payment methods and refunds

3.1 Service credits

In order to use the Services, you must purchase service credits (Service Credits) beforehand. The price for one Service Credit is indicated on the Website. One Service Credit grants access to one interview, and the right to receive a transcript of the interview annotated with feedback on your overall interview performance including on each answer you provided.
The maximum duration of any interview is 30 minutes from the moment you press the “Join Interview” button (Maximum Duration). Once the Maximum Duration is reached, the interview session will be stopped automatically. The actual duration depends on the pace of the interview and may be shorter than the Maximum Duration. If the AI model deems the interview to be concluded before the Maximum Duration, you are free to keep engaging with the agent until the Maximum Duration is reached.
If you leave the interview within 4 minutes after you pressed the “Join Interview” button (e.g. due to technical issues), the Service Credit will not be considered used.

3.2 Payment methods

Purchases of Service Credits are handled through our payment provider Stripe. You must use one of the payment methods that are offered to you by Stripe and you must comply with any conditions and obligations by Stripe.

3.3 Refunds

Once a Service Credit has been purchased, the money will not be refunded.
Service Credits may exceptionally be refunded (i.e., you may receive a new Service Credit for one that has already been used up) if
  • - a technical issue arises on our end (e.g., you were disconnected, or feedback was not shown correctly), and
  • - you provide proof (e.g., in the form of log files or in the form of a screenshot), and
  • - we deem this proof sufficient.

4. Intellectual property

You agree that any intellectual property rights inherent in or used in connection with the Services are and shall remain our property. You may not copy, distribute, or modify any Output without our written permission. The ResidencyAI name or logo may only be used with our written permission. If you provide feedback to ResidencyAI, you allow us to use this feedback without any compensation or restriction.
You hereby grant us a free, exclusive and transferable license, unrestricted in time and space, to use your Input to train the AI models underlying our Services or otherwise improve our Services.

5. Data protection

We respect your personal data and process the personal you provide to us according to our privacy notice which is available at https://medinterviews.ai/privacy.
Even if asked by the AI interview partner, you must not share sensitive information within the meaning of the applicable data protection laws (e.g. patient data, data about illnesses etc., and/or data that includes or constitutes “Protected Health Information” as defined under the HIPAA Privacy Rule (45 C.F.R. Section 160.103)).

6. Limitation of liability

We do not make any representation or warranty that the Output is reliable, accurate or complete or that your access to the Services and/or the Output will be uninterrupted, timely or secure.
We shall not be liable for loss suffered as a result of reliance by you upon the accuracy or currency of any Output.
We shall not be liable for any loss or damage, however caused (including through negligence), which any person may directly or indirectly suffer in connection with or arising from your use of the Services or your use of or reliance on Output. To the extent permitted by law, any condition or warranty which would otherwise be implied into these Terms is hereby excluded.

7. Termination and suspension

We can modify, suspend, or terminate the Services at any time without further notice. Breaches of these terms result in immediate termination and loss of access without refunds.

8. Miscellaneous

8.1 Applicable law, jurisdiction

These Terms are governed by material Swiss law. Any dispute, controversy or claims arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Zurich, Switzerland.

8.2 Modifications of these Terms

We may update these Terms at any time, and we will notify you about material changes. If you keep using the Services, this means that you accept the modified terms.
